Class-IV Employee Cannot Claim Higher or Specialized Post Merely on Basis of Existing Employment: J&K High Court
The High Court has categorically held that a Class-IV employee cannot claim a right to be appointed or continued on a higher or specialized post, such as a technical or clerical position, merely on the strength of their existing employment.
Justice Vinod Chatterji Koul observed that allowing a Class-IV employee to claim a higher post solely because they have been assigned or entrusted with higher responsibilities would amount to bypassing established recruitment procedures and would be contrary to settled principles of service jurisprudence.
