JKP Constable Latest News: CAT Denies Interim Stay on Final Selection List

Big update for JK Police Constable aspirants. As per the latest reports, the Central Administrative Tribunal (CAT) has refused to grant an interim stay on the declaration of the final selection list for JKP Constable posts.


What CAT Has Ordered

The CAT has reportedly directed the Jammu & Kashmir Services Selection Board (JKSSB) to continue the recruitment process in line with the principles laid down by the Supreme Court in the Saurav Yadav case.


About the Saurav Yadav Judgment

In Saurav Yadav v. State of Uttar Pradesh, the Supreme Court clearly ruled that:

Merit must always come first in public recruitment.

Candidates belonging to reserved categories (SC/ST/OBC) who score high enough to qualify in the general category should be counted as general candidates, not against their reserved quota.

This ensures that reserved category seats remain available for other eligible candidates who actually need reservation benefits. 

Impact on Horizontal Reservation

The judgment also clarified that horizontal reservations (such as women reservation) should not block merit-based selection. If a candidate qualifies purely on merit, they should not occupy a reserved seat unnecessarily.
